RabidFox Analytics LLC is not a registered investment advisor, broker-dealer, banker, attorney, or accountant. Nothing in the RFX Banking Analytics app, website, or related materials constitutes investment, financial, legal, tax, or banking advice. All decisions made using RFX outputs are your sole responsibility.

Acceptance & eligibility

By downloading, installing, accessing, or using the RFX Banking Analytics application (the “App”), the rabidfoxanalytics.com website (the “Website”), or any related service (collectively, the “Services”), you agree to be bound by these Terms & Disclaimer (the “Terms”). If you do not agree, do not use the Services.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Services. By using RFX, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

If you are using the Services on behalf of a bank, financial institution, consulting firm, or other organization, you represent that you have authority to bind that organization to these Terms.

License grant

Subject to your compliance with these Terms, RabidFox Analytics LLC (“RabidFox,” “we,” “us”) grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes only.

This license does not transfer ownership of any RabidFox intellectual property. All rights not expressly granted are reserved by RabidFox.

Pro licenses: Are per-seat and tied to your Apple ID. Sharing license keys across multiple individuals violates these Terms and may result in immediate license termination.

Acceptable use

You agree not to:

  • Use the Services to engage in any illegal, fraudulent, or harmful activity
  • Reverse-engineer, decompile, or attempt to extract source code from the App
  • Bypass technical protections, license verification, or feature gates
  • Resell, sublicense, or redistribute the Services without written authorization
  • Use the Services to build a competing product or train competing AI models
  • Upload data you do not have legal authority to use
  • Interfere with the operation of the Services or the experience of other users
  • Use the Services in violation of any applicable law or regulation

We reserve the right to terminate any license for violation of these acceptable use rules, at our sole discretion.

Demo Mode vs. Pro tier

Demo Mode is provided free of charge and includes 18 of 24 dashboards with synthetic data. Demo Mode is offered “as-is” with no service-level commitment and may be modified or withdrawn at any time without notice.

RFX Pro is the paid tier, available via license keys obtained from sales@rabidfoxanalytics.com. Pro provides all 24 dashboards plus the ability to import your bank’s own FFIEC call report data. Pricing and license terms are provided in your written agreement at time of purchase.

License keys are per-seat and non-transferable. Volume pricing is available at 3+ seats. Institutional licensing (for consulting firms and multi-bank investors) is available on request.

Refund policy: Pro licenses are non-refundable once activated. To minimize buyer’s remorse, we offer a 14-day Pro trial. Email sales@rabidfoxanalytics.com to request one before purchasing.

No financial, legal, or banking advice

RFX is an analytical and informational tool. It is not, and shall not be construed as:

  • Investment advice or a recommendation to buy, sell, or hold any security
  • Banking advice, regulatory compliance advice, or supervisory guidance
  • Legal, tax, accounting, or actuarial advice
  • A substitute for professional judgment by qualified advisors
  • Endorsement, certification, or approval by any regulator

RabidFox is not a registered investment advisor under the Investment Advisers Act of 1940, not a broker-dealer under the Securities Exchange Act of 1934, and not a banking institution under any federal or state banking law. We do not provide investment management, portfolio advisory, fiduciary, or banking services.

You bear sole responsibility for any decision you make using RFX outputs. Always consult qualified professional advisors before acting on banking, investment, regulatory, or risk-management decisions.

Data accuracy & sources

RFX uses publicly available FFIEC call report data (Schedules 031, 041, and 051), Federal Reserve Economic Data (FRED), and other public sources. While we make reasonable efforts to ingest and present this data accurately, we make no warranty regarding:

  • Completeness, accuracy, or timeliness of source data
  • Errors introduced by the source providers (FFIEC, FRED, etc.)
  • Calculations, ratios, or derived metrics produced by RFX
  • Peer cohort selections or benchmarking comparisons
  • AI-generated commentary, summaries, or analytical conclusions

You are responsible for verifying the accuracy of any RFX output before relying on it for material decisions.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR TITLE.

WITHOUT LIMITING THE FOREGOING, RABIDFOX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY RABIDFOX OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY.

Some jurisdictions do not allow exclusion of certain warranties, so portions of this disclaimer may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RABIDFOX, ITS AFFILIATES, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, business opportunity, or anticipated savings
  • Loss of data or interruption of business operations
  • Costs of substitute services or procurement of replacement analytics
  • Reputational harm or regulatory consequences
  • Any other commercial damages or losses

Whether based on contract, tort, strict liability, or any other legal theory, even if RabidFox has been advised of the possibility of such damages.

In any event, RabidFox’s aggregate liability for any and all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (i) the amount you paid to RabidFox in the 12 months preceding the claim, or (ii) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow limitation of incidental or consequential damages, so portions of this limitation may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless RabidFox, its affiliates, and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property right
  • Any decision you make based on RFX outputs
  • Any data you upload, import, or process through the Services

Intellectual property

The Services, including all software, source code, designs, dashboards, text, graphics, the RabidFox Drill Method, the RFX trademark, and the RabidFox logo, are owned by or licensed to RabidFox Analytics LLC and protected by U.S. and international intellectual property laws.

You retain all rights to data you upload to or import into RFX. By using the Services, you grant RabidFox a limited license to process your data solely to operate the Services on your behalf.

Feedback: If you provide RabidFox with suggestions, ideas, or feedback, you grant us a perpetual, worldwide, royalty-free license to use that feedback to improve the Services, without obligation to you.

Third-party content & integrations

The Services may reference, integrate with, or display content from third parties, including but not limited to:

  • FFIEC Central Data Repository (call report data)
  • Federal Reserve Economic Data (FRED) macroeconomic indicators
  • Apple Inc. (App Store distribution, Apple Intelligence, iOS frameworks)
  • Anthropic PBC (Claude API for optional cloud AI features)

RabidFox is not responsible for the accuracy, availability, content, or terms of third-party providers. Your use of third-party content is governed by the third party’s own terms and policies.

Apple App Store EULA terms

If you obtained the App from the Apple App Store, the following additional terms apply, as required by Apple Inc.:

  • These Terms are between you and RabidFox only, not with Apple. Apple is not responsible for the App or its content.
  • Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance and support services for the App. Any support questions should be directed to support@rabidfoxanalytics.com.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
  • RabidFox, not Apple, is responsible for addressing any claims relating to the App, including product liability, intellectual property, and consumer protection claims.
  • You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

Termination

You may stop using the Services at any time. Pro license holders may request termination by emailing support@rabidfoxanalytics.com.

RabidFox may suspend or terminate your access to the Services at any time for violation of these Terms, suspected fraud, security concerns, or for any other reason at our reasonable discretion. We will provide notice when practicable.

Upon termination, your license to use the Services ends immediately. Sections covering intellectual property, indemnification, liability limits, governing law, and dispute resolution survive termination.

Governing law

These Terms and any dispute arising out of or relating to them or the Services shall be governed by the laws of the State of Georgia, U.S.A., without regard to its conflict-of-laws principles.

You and RabidFox each consent to the exclusive jurisdiction and venue of the state and federal courts located in Atlanta, Fulton County, Georgia, for any action not subject to the dispute resolution provisions in Section 16.

Dispute resolution

Informal resolution first. Before filing any formal claim, you agree to first contact us at support@rabidfoxanalytics.com and attempt to resolve the dispute informally. We will respond within 30 days.

Binding arbitration. If the dispute cannot be resolved informally, you and RabidFox agree to resolve the dispute through final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Atlanta, Georgia.

No class actions. You and RabidFox agree that disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

Small claims exception. Either party may bring an individual action in small claims court for disputes within that court’s jurisdictional limits.

Some jurisdictions do not permit certain dispute resolution provisions, so portions of this Section 16 may not apply to you.

Changes & contact

We may update these Terms from time to time. When we do:

  • We update the “Last Updated” date at the top of this page
  • For material changes, we notify Pro customers by email at least 30 days before changes take effect
  • Prior versions are archived and available on request
Important: By continuing to use the Services after a Terms update takes effect, you agree to the updated Terms. If you disagree with a change, please stop using the Services and contact us at support@rabidfoxanalytics.com.

These Terms constitute the entire agreement between you and RabidFox regarding the Services. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
